About these terms

These terms are the agreement between you and OdyTech, LLC, trading as Tail & Canvas, when you use our store or our portrait preview service. By uploading a photo or placing an order you accept them.

What the service does

You upload a photo of your pet and choose a style. We generate an original portrait from it, show it to you as a watermarked preview, and let you order it as a print or a digital file. You get three free takes per photo. If you want more, three additional takes cost $3.99 and that fee is credited toward your order.

How portraits are made

Portraits are produced by automated image generation models working from the photo you upload. There is no human illustrator painting your piece, and that is exactly why it takes about a minute instead of days. Each portrait is a new image created from your photo, not a filter applied over it, so the result will differ from your source photo in pose, framing, lighting, and detail. That is the intended behavior, and the free preview is there so you can see the actual result before you spend anything.

The photo you upload

You confirm that you own the photo or have permission to use it, and that uploading it does not infringe anyone's rights. Do not upload photos of other people without their consent, and do not upload anything unlawful, hateful, sexual, or violent.

You keep ownership of your photo. You grant us a license to store it and process it for the purpose of creating your portraits, providing support, and fulfilling your order. That license exists so we can do the job you asked for, and it ends when we delete the photo at your request.

The portrait you receive

When you buy a portrait, you may use it for personal purposes: print it, hang it, gift it, share it. If you want to use a portrait commercially, ask us first.

Because portraits are machine generated, they may not qualify for copyright protection in the United States and some other jurisdictions. We therefore cannot promise you exclusive rights in the image, and we do not claim them either. Separately, the same style applied to a different photo produces a different portrait, so no two customers receive the same piece.

We may use portraits we generate to show what the service does, in marketing and on the store. If you would rather we did not use yours, email us and we will not.

Fair use of the free tier

The free preview is free because most people use it as intended. Do not try to circumvent the allowance, script the service, resell access to it, or scrape it. We limit generation per photo and per network, and we may suspend access that looks automated or abusive.

Prices, payment, and orders

Prices are in US dollars and can change, though a change never affects an order you have already placed. Your order is accepted when we confirm it by email. If a product is mispriced or unavailable, we may cancel and refund the order in full before it goes into production.

You approve the exact artwork before we print it. Once production starts, the piece cannot be changed or cancelled: see our Refund Policy.

Availability

We work to keep the service up, but we do not promise uninterrupted access. Generation depends on providers outside our control, and we may change, suspend, or retire features. If a paid top-up cannot be delivered because of a failure on our side, we refund it.

Liability

To the fullest extent the law allows, our total liability for any claim connected to your order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss. Nothing here excludes liability that cannot lawfully be excluded, including liability for fraud, for death or personal injury caused by negligence, or your statutory rights as a consumer.

Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law rules. Mandatory consumer protections in your country of residence continue to apply to you.
